People v. Sisuphan Essay

Appellant Lou Surivan Sisuphan took $22,600 in cash and $7,275.51 from (Toyota Marin [the dealership] defendant) his employer’s safe on July 3, 2007. He did this in hopes that a coworker would be held responsible for the disappearance of the money and would be terminated. Sisuphan was convicted of embezzlement on April 15, 2008. In June 2008 he appeals from the judgment of conviction, contending that the trial court made a mistake when it failed to instruct the jury that at the time he took the money, he intended to return it before criminal charges were filed. He also states that the trial court excluded evidence on that he restored the money to the company, claiming this evidence proved he never intended to keep it and therefore lacked the requisite intent for the crime. Issue â€Å"The question, before us, therefore, is whether evidence that Sisuphan returned the money reasonably tends to prove he lacked the requisite intent at the time of the taking.† Was his the Fifth Amendment right to present defense and â€Å"all pertinent evidence of significance value to that defense† violated? Rule of Law The Fifth Amendment right to present defense and â€Å"all pertinent evidence of significant value to that defense† was not violated because the â€Å"return of the property is not a defense to embezzlement. Fraudulent intent is an essential element of embezzlement. Although restoration of the property is not a defense, evidence of repayment may be relevant to the extent it shows that a defendant’s intent at the time of the taking was not fraudulent.† Analysis Since Martin Sisuphan was authorized to manage the financing contracts and obtain payments from lenders on behalf of the defendant the lawsuit was effective. It does not matter that there was no intent of stealing the money because Section 508 (of the California Penal Code) states: â€Å"Every clerk, agent, or servant of any person who fraudulently appropriates to his own  use, or secretes with a fraudulent intent to appropriate to his own use, any property of another which has come into his control or care by virtue of his employment is guilty of embezzlement.† Holding The issue is that Susuiphan intended to use the money for a purpose other than to which the dealership entrusted it to him, therefore the evidence that he returned the money before criminal charges were filed is irrelevant. The judgment is affirmed. Plaintiff was sentenced to 120 days in custody and 3 years of probation.

Iraqi arrest perpetrators of saydet al najat church Assignment

Iraqi arrest perpetrators of saydet al najat church - Assignment Example The church building is easy to track as it is one of the two in the Muslim neighborhood located in Baghdad, Iraq. in the At the church grounds, everything appeared normal. The church compound was silent; an individual could hear a pin drop. We proceeded to get a seat in the church as the Sunday proceeding had got underway and the preacher was giving the sermon. Approximately ten minutes into the sermon, a commotion got heard from outside the church. A car screeched into the compound, and there was hesitation by the preacher in his speech. The sound of boots hitting the ground outside the got heard from within the church building. Everyone in the building got visibly terrified from the facial expressions. Shouting from outside the church could now get heard too. The shouting together with the sounds of the boots neared the church building entrance (Pope, 2002). The preacher had by now stopped preaching. He asked the ushers to head outside and check on what was taking place. No sooner had the first usher got to the entrance, that gun sounds got heard. Everyone in the church started running helter skelter looking for a hiding place and heading out of the building via other church exits. Everything was happening so fast while time appeared to halt. My husband had meanwhile taken the child and lay under a church bench. I quickly followed suit! The shooting got rampant as cries got louder. Bullets were flying all over the building as evidenced by a shell that fell just besides me under the seat. My husband held our daughter’s mouth to prevent her from wailing. As the gunmen ceased to fire, they quickly ran out of the building shouting to each other in jubilant mood. Ten minutes passed, and not a soul moved about in the church. Police sirens got heard from outside the compound. Within seconds, police got in the building asking those still hiding to come out. There was hesitation at first, but slowly people crept out of their hiding places. The devastation was c lear, dead bodies got left scattered in the church. Bullet shells lay all over the building (Pope, 2002). Blood marks were everywhere. The police led the survivors into waiting police cars as they continued with their investigation. News crews had gathered outside as survivors got received by counselors. My family and I got taken for a check up in a nearby ambulance. This experience could get described as twenty minutes in hell. Fast forward a month later and hundreds of Iraqi Muslims and Christians in Baghdad's Karrada neighborhood take to the streets in celebration. This followed the announcement that the perpetrators of the attacks on the Sayedat al-Najat Church got arrested. Residents of the neighborhood that saw the October 31st attacks launched fireworks and played patriotic songs in cafes, shops and residences. Al-Qaeda leader arrested The Iraqi Ministry of Interior announced the arrest of the terrorist cell that gets believed to be responsible for the attack that targeted th e church in central Baghdad late last month. Scores of people got killed and wounded. Security forces made the arrests during a raid on November 24th at dawn targeting a residential building in the al-Dawoodi neighborhood in central Baghdad. The building got used by the suspects as headquarters, Maj. Gen. Ragheef, director of internal affairs, Ministry of Interior, said in a press conference held Saturday evening in Baghdad (Pope, 2002). Ragheef said the group consisted of 12 suspected terrorists,

Finance and international tread question Essay Example | Topics and Well Written Essays - 1000 words

Finance and international tread question - Essay Example These rules and understandings can include informal routines to formal standards for what makes up acceptable conduct and that are sometimes exemplified in an organization, sometimes not. c) Coordination is likely when it is concerned with sustaining an existing set of behaviours and policies (when it is concerned with sustaining a policy regime) than when it is focused on altering policies. d) Monetary, financial, and macroeconomic coordination is most likely in the scenario of extensive comity among countries. Conflict over other matters, whether economic or not, stifles efforts to agree even on technical financial and economic policies (Krugman & Obstfeld 2003, pg. 56). This paper will discuss why the coordination of international trade and financial policy has been so difficult by looking at the reasons why it has proved to be such a challenge for most countries. Key terms Coordination of international trade and financial policy; monetary, financial, and macroeconomic coordinatio n Discussion The current environment for coordination of international trade and financial policy is very different compared to that of the early post-World War 2 period when many long-term conventions of coordination were created under the General Agreement on Tariffs and Trade (GATT). There have been significant changes in the policy environment that is required to support coordination (Baldassarri, Paganetto & Phelps 2002, pg. 18). These changes include the balancing of influence among national governments vis-a-vis U.S dominance in the period following WWII, and the establishment of new administrative tools of trade policy as a replacement for the limitations that the GATT coordinated successfully for tariffs. In the economic environment ideal for coordination, the most important change has been the emergence of large, mobile conglomerates that themselves practice cross-border coordination. They are multinationals in both ownership and operations (Sutherland 2004, pg. 30). These changes have been captured in the intellectual environment through the creation of an evaluation of the coordination of trade policy in strategic environment - those with few large rival governments and/or firms – that has challenged views from the esteemed competitive consensus (Branson, Frenkel & Goldstein 2010, pg. 57). These environmental changes coexist with each other. Multinationals make it difficult for any government to define, establish, and implement its â€Å"own† national concerns. Returns accruing from the capital endowment owned by a country’s residents depend on revenue drawn from far-flung foreign partners as well as domestic revenue (Jones & Kenen 2005, pg. 49). Discriminatory border regulations that maximise revenue from one source to the detriment of another have ambiguous ramifications on multinational companies and their owners. Strategic influence over the competitiveness and location of huge, mobile multinationals is a reasonably importa nt goal of modern trade policy, and leads to worries over market access and administrative tools like tax incentives, performance requirements, and unitary tax systems

GENDER AND JIM CROW Women and the Politics of White Supremacy in North Essay

GENDER AND JIM CROW Women and the Politics of White Supremacy in North Carolina, 18961920 - Essay Example The book revisits the history of oppression of blacks by white supremacy in the nineteenth century in the state of North Carolina and in the process makes many startling revelation hitherto either ignored or suppressed. Her theses is the emissarial role of contemporary African American women during 1896-1920 when their husbands, fathers ,brother and sons had been denied of surfage, in bringing out African American men and women to the main stream politics in North Carolina hitherto denied due to machinations of American white men. Gilmore reminisces as a young white North Carolinian girl her varied experiences and steps into the shoes of few African American women who had acted as ambassadors to their white male American counterparts by coming to the mainstream though not directly in politics but through academics, social organizations and other charitable institutions. The book which showed Gilmore as the historian in the making also was the precursor to her stream of further works on African Americans endless saga in the U.S. even today. It was by a chance discovery of discrete participation of African American women who were wives of the church leaders, or themselves teachers, college professors in finding a solution to overcome the supremacy of whites over blacks in North Carolina that prompted her to write this dissertation as conferred by her in the introduction pages of the book. I initially encountered this group of black middle-class women while investigating the 1920 election in North Carolina, the first in which women voted..That investigation of women's political culture soon doubled back on itself as I realized that gender and race were no less intertwined in men's politics than they were in women's.( Gilmore, 1996 p xvi) Kennedy in his review of the book says that Glenda Gilmore has re-examined the early period of Jim Crow and made known the to the world the efforts of middle-class African American women like Sarah Dudley Petty to bring about change in their social status by improving their standard of living, identifying opportunities for the both blacks and whites and most importantly changing the attitude of white toward the blacks in North Carolina. How the Women's Christian Temperance Union (WCTU) enabled the African American women of North Carolina to forge an interracial harmony and build strong communities is a case in point cited by him. The WCTU became a base for facilitating equality between whites and blacks in North Carolina. Thus when black men could finally vote, it was the white women who welcomed encouraged the activism of black women too. (Kennedy 2004) Judy(1997) whose grand father William J. Trent, finds a mention in Gilmore's book among so many others, writes how he must have felt having lost right to vote in 1900 in spite of going to college, learning languages like Latin. She is sure her grand mother Maggie Tate Trent must have also contributed a lot by joining the Salisbury Colored women's Civic League that toiled hard for getting African American women also secure voting rights. She agrees with Gilmore that down turn in the economy at that time that forced white men to compete with black men by bringing about repression of blacks and their disenfranchisement in 1900 and that it the was learned black women who became ambassadors of black community in North Carolina

Alfred Hitchcock Essay Example | Topics and Well Written Essays - 1250 words - 1

Alfred Hitchcock - Essay Example After attending the London County School of Engineering and Navigation, he tried to participate in World War I but was rejected by the military because of his obesity. Undaunted, Hitchcock joined the cadet regimen of the Royal Engineers in 1917. Although he did his part during training, he still did not make it to active military service. Eventually, the man who had previously worked as a draftsman and advertising engineer at Henley's would go on to become one of the most prolific writers of the in-house The Telegraph where he began to dabble in stories rooted in suspense and twist endings. As a writer, he tried his hand at writing various genres including the satirical disquisition â€Å"The History of Pea Eating† and Fedora, which is considered as his shortest and most enigmatic contribution to the literary world (â€Å"Alfred Hitchcock†). Finding work as a title designer led Hitchcock to discover photography, which in turn led to his working as Islington Studios as a silent film title card designer. Hitchcock began a steady 5 years ascent to film director from the moment he began working for Islington Studios. Working steadily in Germany as a collaborator of acclaimed film director Graham Cutts in 1924, the length of time that he spent living and working there influenced his â€Å"seminal† and expressionist film making style. Just like any other film maker just starting out, his career was plagued by budget constrictions, canceled films due to lack of budget, and lackluster ticket sales. Yet Hitchcock soldiered on and became one of the most notable film directors in England for his early films. The most notable of his early work was â€Å"The Lodger: A Story of the London Fog†, which was released in 1929. A majority of film historians believe that this movie in particular set the style for the future films of the director. It was in describing this film that the term â€Å"Hitchockian† was first used as there seemed no bett er or fitting term with which to describe the story he told on film (â€Å"Alfred Hitchcock†). Most of Hitchcock's early films made in Britain are silent films. His tenth film however, titled â€Å"Blackmail† which was shot in 1929, is considered to be an early British â€Å"talkie† considered by many to be the first ever British sound feature film. This film is also notable for having the longest appearance by the director in the movie, as was Hitchcock's signature in all his films. More importantly, this film set the trend by the director of using important landmarks in the country as backdrops for the highlights of his movies. By the 1930's his name was becoming well known far and wide thanks to the success of his films â€Å"The Man Who Knew Too Much† and â€Å"The 39 Steps†. This resulted in the American film producer David O. Selznick actively bidding for his services, winning a 7 year contract with the soon to be highly acclaimed film direct or. Hitchcock left England for a new career in the colonies in March, 1939. (â€Å"Alfred Hitchcock†), believing that he had reached the limits of the British film industry. The golden age of Alfred Hitchcock as a film director occurred during his stint in Hollywood where, unhampered by budget issues, he was able to tell the story that he wanted, regardless of how much film footage it took to do so. The audience lapped up

Where to Invest Housing Vs Stock Market Essay Example | Topics and Well Written Essays - 500 words

Where to Invest Housing Vs Stock Market - Essay Example This also means that the investors have to rationally decide investing into different markets and instruments which coincide with their investment preferences therefore, choosing between investing into stock market or housing market is based on such investment preferences. It is generally believed that prices in housing market tend to inflate at the time when stock market performs better. This correlation suggests that a high performing stock market tend to improve the overall economic environment which also supports other markets. However, what is also important is the fact that while considering making a decision to investing into housing or stock market is dependent on the returns offered by the alternative investments at the acceptable level of risk. (Blake, 2000). Therefore, if all other things do not change; investor will make a decision where return is higher and risk is minimum. What is however, most critical is the fact that investors often face dilemma when the respective risk profiles of markets start to show greater volatility. It is very well known that making an investment into stock market is the riskiest investment because stock markets, historically, have shown greater volatility, hence greater risk, over the long period of time.
